1. Your right of access

PAIA gives effect to the constitutional right of access to information. It allows any person to request access to a record held by a private body, such as Hydramatics, where that record is required for the exercise or protection of a right. We are not obliged to disclose every record, and some records are protected from disclosure by law, but every request is considered properly and answered within the statutory time.

3. How to make a request

To request access to a record, please:

• Complete the Form 2 request form above as fully as you can.
• State clearly which right you are seeking to exercise or protect, and explain why the record is required for that right. For a private body this is a legal requirement, and a request that does not identify a right may be refused.
• Tell us the form of access you prefer (for example an emailed copy, a printed copy, or inspection at our premises) and how you would like us to correspond with you.
• Attach proof of your identity. If you are requesting on behalf of someone else, also attach proof that you are authorised to act for that person.

4. What happens next

• We will acknowledge your request and confirm the reference we have given it.
• We will decide on your request and notify you within 30 calendar days of receiving it (section 56 of PAIA).
• In limited circumstances, for example where the request covers a large number of records or requires us to consult others, we may extend this period once, by up to a further 30 days (section 57). If we do, we will tell you in writing, with reasons, before the first 30 days are up.
• If access is refused, we will explain the grounds and tell you how to take the matter further.

5. Fees

PAIA allows a private body to charge a prescribed request fee, payable before a request is processed, and an access fee calculated on the form of access and the time reasonably required to find and prepare the records. We will tell you the access fee, if any, before we proceed, so there are no surprises. The fees that may apply are set out in our PAIA Manual.

6. How we handle your information

We collect only the personal information needed to process your PAIA request and to verify your identity. We use it solely to handle and respond to your request and to meet our reporting duties to the Information Regulator. Access to a request is restricted to our Information Officer. Information you submit is transmitted over a secure (HTTPS) connection. We retain PAIA request records for three years after a request is closed, after which they are securely deleted. 7. Complaints

If you are unhappy with how we have dealt with your request, you may lodge a complaint with the Information Regulator of South Africa: inforegulator.org.za, or by email to PAIAComplaints@inforegulator.org.za.
